Posted August 2, 2023Medicare (CMS) prohibits the promotion of benefits in the absence of product availability unless using local or regional media that serves the service areas makes it impossible to prevent it.
Agents must only advertise plans and benefits to beneficiaries who live in a plan's coverage areas, unless the nature of the advertisement makes it impossible to do so. Examples of "unavoidable" events include a TV advertisement that might be picked up in a neighboring market or a newspaper ad published to beneficiaries who live in the metropolitan region but outside of the plan's service area.
